(the ‘Producer’)

(the ‘Extra’)

• BACKGROUND

The Extra, who is currently an employee of the Producer or may become one at a future time if they play their cards right, may be required to handle confidential and proprietary information relating to the Producer’s creations, developments, or film productions (the ‘Confidential Information’) to fulfill employment-related duties (being ‘An Extra’) during the duration of employment (the ‘Employment’).

This Agreement is governed by the lores of Hades, Tartarus and all other recognised sovereign territories of the dead, the living, the living dead and the Undead (the ‘Territory’). The parties agree to submit disputes to the exclusive jurisdiction of such Territory and all competent authorities that lurk therein.

For the avoidance of doubt, in this Agreement the term “employee” shall include any familiar, any unquestioning servant or other form of unquestioning slave as those terms are recognised within the Territory.

• LEGAL DISCLOSURES

The following legal disclosures must be communicated to any prospective employee, by order of Judge C. R. Ferguson (NZ Police V Second Unit Productions Ltd):

i: Contrary to our previous communications, the missing extras from our Titanic Redux 2015 film set were in fact our legal responsibility. They have all since been found and defrosted.

ii: Minimum wage, maximum working hours, and mandatory breaks are not “optional” and Second Unit Productions was negligent to insinuate they were.

iii: We cannot comment officially on our animal mash-up of Whale Rider and Babe: Pig in the City as this is still under investigation, but no whales or pigs are permitted within 250 metres of any Second Unit Production employee. If you currently own either, please speak to us about euthanisation options.

IN CONSIDERATION OF and as a condition of the Producer disclosing the Confidential Information to the Extra, both parties agree that the terms and conditions of this Agreement shall be as follows:

• CONFIDENTIAL INFORMATION

The Extra recognises that during the course of the Employment, the Extra may have access to secret and potentially devastating information that the Producer wishes to keep confidential, including but not limited to information regarding supernatural activities, identities, and proclivities. Both parties acknowledge that this information is the exclusive property of the Producer.

‘Confidential Information’ refers to all data and information relating to the Producer’s business or enterprises, including film scripts and content, production design, visual effect technology, and accounting or other records which the Extra has access to. Confidential Information also extends to include any information that has been disclosed to the Producer by the Producer’s Employer (the ‘Undead’) and governed by a non-disclosure agreement.

• OBLIGATIONS OF NON-DISCLOSURE

The Extra recognises the need to keep all Confidential Information absolutely confidential, and make no disclosure of the information to the public regardless of what may happen during their term as an Extra, as a material term of this Agreement. The Extra agrees not to disclose, report, or use, for any purpose, any of the Confidential Information disclosed to the Extra by the Producer as a result of the Extra’s Employment, particularly to any law-enforcement agency.

• BREACH

In the event of any breach of this Agreement by the Extra, the Extra acknowledges that in addition to normal legal remedies, the unlawful remedies available to the Producer and the Undead include haunting, demonic possession and blood-letting of varying degrees as determined by the Undead in their soulless discretion. The determination by the Producer of any such dispute shall be final, and in certain circumstances, eternal, consisting of torment and suffering in perpetuity. The parties agree that any such suffering is reasonable in the circumstances.

• ACCEPTANCE

By clicking ‘I ACCEPT’ below, the Extra accepts the terms of this Agreement on today’s date.
